H.R. ## - The Comprehensive Gun Safety Act of 2025
Section 1: Short Title
This Act may be cited as the "The Charlie Kirk Memorial Gun Control Act"
Section 2: Findings and Purpose
Findings
Congress finds that:
Gun violence continues to be a significant public safety concern in the United States
Enhanced background check systems can help prevent firearms from reaching prohibited persons
Military-style weapons pose unique risks to public safety when in civilian hands
Mental health screening and intervention can reduce firearm-related tragedies
Responsible gun ownership includes proper training and safe storage
Purpose
The purpose of this Act is to:
Strengthen background check requirements to prevent dangerous individuals from obtaining firearms
Enhance mental health screening and support systems to identify potential threats
Regulate access to high-powered rifles and military-style assault weapons that pose risks to public figures and citizens
Combat domestic terrorism and politically motivated violence
Promote responsible gun ownership through training and safe storage requirements
Protect Second Amendment rights while safeguarding democratic institutions and public safety
Honor Charlie Kirk's legacy by ensuring that political discourse can occur safely in America
Section 3: Enhanced Background Check System
Universal Background Checks
All firearm sales, including private sales and gun shows, must include a background check through the National Instant Criminal Background Check System (NICS)
Exceptions limited to transfers between immediate family members and temporary transfers for hunting or sporting events under direct supervision
Enhanced Screening Criteria
Expand prohibited persons categories to include:
Individuals convicted of misdemeanor domestic violence
Persons subject to domestic violence restraining orders
Individuals with felony convictions for violent crimes involving weapons
Persons adjudicated as mentally defective or committed to mental institutions
Waiting Periods
Mandatory 7-day waiting period for all firearm purchases
Extended to 14 days if background check reveals potential disqualifying information requiring further investigation
Section 4: Mental Health Screening and Support
Enhanced Mental Health Reporting
States must report mental health records to NICS within 30 days of adjudication
Federal funding incentives for states that improve mental health record reporting
Mental Health Evaluation Requirements
Purchasers must provide mental health clearance from licensed mental health professional if:
Previously hospitalized for mental health treatment
Currently prescribed psychiatric medications
Self-reported mental health concerns on purchase forms
Mental Health Support Programs
$500 million annually for community mental health programs
Crisis intervention training for law enforcement
Mental health first aid programs in schools and workplaces
Section 5: Assault Weapons and High-Capacity Magazine Regulation
Assault Weapons Definition
Military-style assault weapons include semi-automatic firearms with:
Detachable magazine and two or more of the following features:
Folding or telescoping stock
Pistol grip
Bayonet mount
Flash suppressor or threaded barrel
Grenade launcher mount
Regulations
New manufacture, sale, or transfer of assault weapons prohibited
Existing lawfully owned assault weapons must be:
Registered with ATF within 180 days
Subject to enhanced background checks for transfers
Stored in approved secure facilities when not in use
High-Capacity Magazine Restrictions
Prohibition on manufacture, sale, or transfer of magazines holding more than 10 rounds
Existing high-capacity magazines subject to registration requirements
Exceptions for law enforcement and military use
Section 6: Licensing and Training Requirements
Federal Firearms License for Individuals
All gun owners must obtain federal firearms license within one year
License requirements include:
Background check renewal every 5 years
Completion of firearms safety course
Demonstration of safe storage capabilities
Liability insurance coverage
Mandatory Training
8-hour safety course covering:
Proper handling and storage
Legal responsibilities
De-escalation techniques
Mental health awareness
Refresher courses required every 5 years
Section 7: Safe Storage Requirements
Mandatory Secure Storage
Firearms must be stored in locked container or with trigger lock when:
Not under direct control of owner
Minors present in household
Prohibited persons have access to premises
Penalties
Criminal liability if improperly stored firearm used in crime
Civil liability for injuries caused by improperly stored firearms
Enhanced penalties if minor gains access to improperly stored weapon
Section 8: Red Flag Laws
Extreme Risk Protection Orders
Family members, law enforcement, and mental health professionals may petition courts for temporary removal of firearms from individuals posing risk to themselves or others
Due process protections including:
Hearing within 14 days of temporary order
Clear and convincing evidence standard
Right to legal representation
Annual review of continuing orders
Section 9: Enforcement and Penalties
Enhanced Penalties
Violation of universal background check requirements: Up to 5 years imprisonment
Illegal possession of unregistered assault weapon: Up to 10 years imprisonment
Failure to properly store firearms resulting in injury: Up to 3 years imprisonment
Enforcement Funding
$1 billion annually to ATF for enforcement activities
$500 million annually for state and local law enforcement training and equipment
Section 10: Implementation and Effective Date
Phased Implementation
Universal background checks: Effective 90 days after enactment
Mental health screening: Effective 180 days after enactment
Assault weapon registration: 180 days after enactment
Licensing requirements: Effective 1 year after enactment
Funding Authorization
Such sums as necessary for fiscal years 2025-2030
Funding sources include federal excise taxes on firearms and ammunition
Section 11: Judicial Review and Severability
Constitutional Protection
Nothing in this Act shall be construed to infringe upon Second Amendment rights
Provisions for licensed, law-abiding citizens to possess firearms for lawful purposes
Severability
If any provision of this Act is held unconstitutional, the remaining provisions shall remain in effect.
